Woman Hits Herself with Her Own Car; Rushed to Emergency

auto accident, auto accident lawyer, insurance

February 15th, 2010: Law Blogger

2700 block 127th ave, vancouverVancouver – A woman was out looking for her dog last week. The good news is she found it. Then the situation turned weird.

The odd incident happened about 4:45 p.m. Monday in the 2700 block of Northeast 127th Avenue, in the Burton area of Vancouver, said Capt. Bill Garlington with the Vancouver Fire Department.

The woman got out of the car, Garlington said, hoping to coax her dog inside and apparently failed to put the transmission in park or otherwise make sure the car would stay stopped. When the car kept moving, she stumbled and was injured by the car.

En route to the hospital, medics called a trauma alert, notifying hospital emergency room staff to be ready, Garlington said.

The 21 year old Vancouver Washington resident is named Samantha Gardner, confirmed Officer Ilia Botvinnik with the Vancouver Police Department. She was in the emergency department at Southwest Washington Medical Center, said a nursing supervisor. Pending results of X-rays and scans, her condition hadn’t been determined.

This embarrassing situation could have been avoided if she had merely been patient, made sure her car was in park, and not moving.

Patience is one of the most important parts of defensive driving and quells feelings of  stress and panic which can lead to serious injuries.

Young Washington Drivers and Auto Accidents

alcohol, Auto Accidents, fatalities, inattention, injuries, insurance, speeding, texting, Washington auto accidents lawyers, young Washington drivers

October 21st, 2009: Washington Law Blogger

Washington’s driving and accident statistics are generally similar to those you’d find in the rest of the country, and one of the more troubling sets of statistics involves young drivers. Generally speaking, young drivers face a higher risk of death and serious injuries behind the wheel as compared to older drivers, and these situations are often tragic in nature. As such, Washington auto accidents lawyers are regularly fielding incoming inquiries regarding the rights of those injured or killed in such situations.

The issue is such that October 18th – October 24th has been declared to be “Teen Driver Safety Week” in Washington, and the event is an effort to bring awareness to the risks involved with young drivers and to help alert anyone to steps that can be taken that lead to safer roads and fewer problems for young Washington residents who get behind the wheel.

One look at some basic statistics can explain why such a week has been planned. According to the Washington Traffic Safety Commission (WTSC), 140 people between the ages of 16 and 19 have been killed in auto accidents in Washington, and more than 400 have been seriously injured. The leading causes of these accidents appears to include speeding, drug and/or alcohol impairment, inattention or a combination thereof.

Young drivers are also much more likely to play loud music, joy ride and use their phones for calls and/or texting while driving, all of which only adds to the dangers that these young drivers incur. These risks also create danger for anyone else who happens to be sharing the road with them at any given time, thereby creating a situation where the state government decided to take action.

This is also the reason that insurance premiums tend to be more expensive for young or new drivers than for almost anyone else. The insurance industry assesses risks, and clearly they see young drivers as the biggest risk within this context. If you or someone you love has been injured or worse by a young driver in Washington or by anyone else, you need to contact a Washington auto accident lawyer at Phillips & Webster today to schedule a free initial consultation.

Why You Need to be Prepared

auto accident attorneys, Auto Accidents, fatal accidents, injury accidents, insurance, property damage collisions, seattle, Washington

June 5th, 2009: Washington Law Blogger

We’ve been covering in some detail what you need to remember and what you need to do in the aftermath of a car accident in Washington, and there are many reasons why this is important. One of them is because of a basic statistical analysis, it’s quite possible that you or someone you love will be involved in some sort of traffic collision during your lifetime, particularly if you drive often as part of your routine.

Below are some of those statistics that are published by the Washington State Department of Transportation for the year of 2005:

1. Total reported collisions – 51,901

2. Fatal collisions – 274

3. Disabling injury collisions – 890

4. Evident injury collisions – 5,010

5. Total injury collisions – 19,541

6. Property damage collisions – 32,086

As you see, if you add this up over a period of years, you are taking a risk every time you hit the road. It should be restated that the statistics above only represent collisions that are reported, and not those that are simply handled without insurance companies or the police getting involved.

Clearly, everyone who uses the roads in Washington needs to drive with the ultimate defensive style, but even then there could come a time when an accident occurs that is simply not your fault and could not have been avoided. That’s why it’s important to remember how to proceed in such a way that you maximize your safety, minimize the risk of additional injuries occurring and such that your rights are protected.

Therefore, if you’ve been injured in an auto accident in Seattle, you need to contact the attorneys at Phillips & Webster today to schedule a free initial consultation.

The Aftermath of a Car Accident, Part II

attorney, auto accident, documentation, injuries, insurance, legal rights, medical evaluation

June 1st, 2009: Washington Law Blogger

We posted some suggestions recently about what to do in the immediate aftermath of a car accident where no one was seriously hurt. While those suggestions should be kept in mind so that you don’t have to sit and think about what to do while so many thoughts and emotions are running through you during those first few seconds/minutes, those actions are only the start of an entire process.

Today, we’d like to continue with this analysis so that you can continue to do what needs to be done in terms of recovery from any injuries you have sustained and not worry about how you should proceed in a way that protects your legal rights and options. As you’ll see below, some of the steps taken will be initiated by other parties.

1. Your insurance – Obviously, if you were in a car accident, there was likely some damage done to your vehicle. You will need to contact your insurance company to file a claim for those repairs, and when you do so you’ll need to provide the information you obtained regarding the other driver’s identity and insurance coverage.

2. Your health – When you obtain your medical evaluation, make sure you ask for documentation of any diagnoses made, prescriptions ordered or follow-up care that’s going to be necessary if you have suffered any sort of injuries. You should also make copies of any documentation your doctors provide that states you must miss time at work if that’s necessary.

3. Their insurance – After you’ve filed your claim, it’s quite possible that you will hear from the other driver’s insurance company as they pursue a statement from you. If this happens, do not offer one. There’s no need to be rude – politely decline to give a statement at that time and get off the phone.

4. Work with a Seattle auto accident attorney – The best way to make sure that you are doing things properly is to work with an attorney who has the experience to handle all of this for you. He or she will be able to deal with gathering your documentation and records as well as the other party’s insurance company.

If you have been injured in an accident, contact Phillips & Webster today to schedule a free initial consultation.
