Wrongful Death: 3 ½ Year Sentence for Fatal Pedestrian Hit and Run Accident

Worngful DeathDeputy Prosecutor Doug Shae said that nearly the whole court was crying when Michael D. Burke, 34, of Wenatchee made his tearful apology for hitting and killing Arnulfo Garcia Maldonado, 47, also of Wenatchee, then running after the accident.

The vehicular homicide charge had been dropped and instead Burke pleaded guilty in Chelan County Superior court to causing a hit and run injury accident and negligent driving.

People remained crying while the sentence of three and a half years was read to the court.

“It was so emotionally draining,” Shae said. “It was like a funeral.”

Burke’s immediate family members wrote letters to the Judge asking for leniency. In her letter the Burke’s wife, Linda, asked that he be allowed to go through counseling and rehabilitation, rather than be sentenced to jail time, a seemingly unrealistic request when a man with a family is dead.

Keith Howard, Burke’s attorney, asked the court to consider another form of leniency by granting his client a special offender sentence that would have allowed him to attend counseling and rehabilitation while in prison and then be released after only 18 months.

Judge John Bridges considered the pleas for leniency, but instead decided to sentence Burke to three years and five months, which is in the high end of the sentencing range.

Hit and Run Fatality Accident

Garcia’s wife told police that her husband had been drinking beer at their home at an unspecified time in the early evening of Sept. 19, 2009. In the statement she said that he wanted to drive somewhere, but she took away his keys, so he took off on foot.

Around 1 a.m., Garcia was crossing North Wenatchee Avenue near Shari’s Restaurant. Another driver who stopped to allow Garcia to cross the road said he saw a dark pickup speed around the corner and strike Garcia, then speed away after the impact.

The driver called 911 and an ambulance rushed to the scene and drove Garcia to Central Washington Hospital.

Concerned family members went looking for Garcia when he didn’t come home. They quickly came upon the accident scene. They saw his characteristic cowboy hat laying in the road and knew something bad happened. Police at the scene told them to go to Central Washington Hospital.

Garcia died two hours after the accident in the emergency ward.

Returning to the Scene of the Crime

Serious Personal InjuryAt 4:45 a.m., East Wenatchee police officers keeping an eye out for a dark-colored pickup with damage to the front found one parked near the Cedars Inn off Valley Mall Parkway. They immediately identified Burke as the registered owner and began searching for him.

It wasn’t until 18 hours later that they found Burke and arrested him outside the Roaster and Ale House in downtown Wenatchee. He’d gone there after drinking at Sharx Bar & Bites, across North Wenatchee Avenue.

In statements made to police by Burke and another man who hung out with him on the night of the hit and run, after Burke hit and killed Garcia, he drove to the Clearwater Steakhouse & Saloon in East Wenatchee where he commenced to drink with a friend. He told his friend that he was driving around 70 mph when he plowed over someone with his truck. Burke then left Clearwater and went to the Shari’s in East Wenatchee where the accident had happened. The investigation had since cleared from the scene allowing him to eat his food in peace.

Wrongful Death

In his plea statement, Burke admitted that he had the smell of alcohol on his breath at the time of the incident and that he caused the accident that killed Garcia. But Shae said that since Burke was not found and arrested until 22 hours after the accident, there was no blood-alcohol or breathalyzer data to prove that he was driving under the influence at the actual time of the accident. This is critical for the vehicular homicide charge to stick.

Though we can only speculate as to whether Burke was drunk at the time of incident, generally sober drivers don’t scream through an intersection at 70 mph with cars waiting for a pedestrian to cross the street. As for running after hitting the pedestrian that is just a character issue for Burke, as is returning for food with a view of the scene. Regardless of Burke’s tearful apology, that still does not bring Garcia back.

Alcohol and speeding seem to be an unfortunate match when it comes to driving in certain circumstances. Many times, a DUI accident involves reports of the driver speeding before a crash, and this combination is as dangerous as it gets. That notion was reinforced recently in Allyn, but despite the severity of the crash, it fortunately did not lead to any fatalities. It did, however, result in serious injuries to two of the vehicle’s occupants.

According to the Kitsap Sun:

“A 19-year-old Allyn man was driving a 2007 Ford Focus west on the 700 block of East Lake Shore Drive in Lakeland Village at about 10:15 p.m. when the car left the roadway and crashed, deputies said.

An unidentified male passenger was seriously injured, said Mason County Chief Deputy Dean Byrd, and taken to Harborview Medical Center by helicopter. He is listed in serious condition at the Seattle hospital.

A 17-year-old Allyn girl was taken to Mason General Hospital in Shelton and later flown to Harborivew. She is listed in serious but stable condition, Byrd said.”

The driver was booked on suspicion of DUI, and investigators have yet to gather and publish all of the evidence that relates to the accident. Two Women Seriously Injured in Everett Crash

Turning left and across oncoming traffic can be a dangerous maneuver, particularly if a traffic signal is involved and drivers coming in the other direction are attempting to avoid being stopped by the light. Judging another vehicle’s speed and closing distance can be difficult for anyone, especially at night. Unfortunately, two women had to suffer the results of misjudging what an oncoming vehicle could do when making such a turn.

According to an article published by King 5:

Two women were injured in a collision that ripped a car in half Thursday night.

According to a report in the Everett Herald Newspaper, the women were in a Ford Taurus that was going north on Evergreen. As they began to turn into the parking lot of a K-Mart store the car was hit by a Pontiac GTO heading southbound. The fiery impact tore the Taurus in half.

The Herald reports that witnesses say the Taurus was split in half just behind the front seats and that the front half of the car spun around before coming to a rest on the sidewalk in front of the store. They say the back half of the Taurus instantly burst in flames.”

Investigators are looking into the possibility that alcohol was a factor in the crash. Police also want to ascertain whether the driver of the GTO was speeding or sped up in an attempt to beat the traffic signal that was nearby. Many who live in or around Seattle take advantage of the proximity to all that British Columbia has to offer to the immediate north and take short trips there to enjoy such cities as Victoria. One family appears to have done just that over the weekend, but theirs was a trip that ended in disaster before they arrived at home. Two people were killed and three more injured in an auto accident just south of the Hood Canal Bridge.

According to the Seattle Times:

“A Kent mother and her two children were taken to a Bremerton hospital late Saturday after a collision on Highway 3 killed both the woman’s husband and the man driving the vehicle that struck the family’s Jeep Grand Cherokee, according to the Poulsbo Fire Department.

The Kent family had spent the day in Victoria, B.C. and were on their way home, driving south on Highway 3, according to a fire department news release.

They were just south of the Hood Canal Bridge when a man, driving north in a Jeep Cherokee, collided with their vehicle at approximately 11:30 p.m. Saturday, the release said.

Both men were declared dead at the scene. Their names and ages, along with the second man’s hometown, were not immediately known.

An 11-year-old boy suffered critical injuries while his mother and 4-year-old sister suffered serious injuries, the release says. All three were taken to Bremerton’s Harrison Hospital.”

While much is yet to be resolved in the forthcoming investigation, this is a tragedy that will not be overcome by the survivors in many ways. Child Seriously Injured in DUI Accident

When someone makes the bad decision to drive after drinking, everyone is put at risk. This includes the driver, any passengers, and vehicles that happen to be on the road at that time, any pedestrians and bikers and apparently, nearby homeowners. What’s worse is when the passenger in the car being driven is a child who is not wearing a seat belt. Sadly, that appears to be the case with a recent DUI crash that also damaged a home.

According to KVBC:

An eight-year-old boy is in critical condition following a DUI accident on Sunday near Michael Way and Smoke Ranch. Police say the man behind the wheel was the boyfriend of the child’s mother. Police say it started as a hit-and-run when the driver slammed into a parked car. He then left the scene, hit a light pole, and crashed through a brick wall into the side of a home.

Metro says the eight-year-old boy was not wearing a seat belt and was bouncing around inside the vehicle. Sadly, we’re being told he may not survive his injuries.”

It’s obvious that the suspect will face a serious problem in terms of criminal prosecution. Wrong-Way Crash on I-90 Leaves One Dead, Five Injured

While no one yet knows exactly what was happening with the driver of a wrong-way vehicle on I-90 early this morning, when such an occurrence takes place at 2:45 a.m., most will make the very short logical leap that alcohol was involved. Although an investigation is beginning as of this writing, the tragic results are already cemented in place – one person is dead and five people were injured as a result of this crash that occurred this morning.

According to the Seattle Post-Intelligencer:

“The State Patrol says a wrong-way driver is to blame for a head-on collision on I-90 east of North Bend that killed one person and injured five.

Trooper Dan McDonald told KIRO-TV a car was driving westbound in the eastbound lanes at 2:45 a.m. Friday when it collided with a pickup truck with five men inside.

The crash killed the driver of the car. McDonald says two of the men in the pickup are critically injured and three are in serious condition.”

When people drive late at night and/or early in the morning, there is simply no way to be too defensive. Hit-and-Run Leaves Seattle Woman Fighting for Her Life

Seattle authorities are asking for help from anyone who may have information regarding a hit-and-run accident that left an area woman seriously injured and in critical condition. Sarah Kearney is the victim of the crash, and she is listed in critical condition. She is breathing on her own and responding to commands, but is still in danger with serious head injuries.

According to KOMO News in Seattle:

“Kearney was driving home Tuesday night on Highway 18 when a truck crashed into her near the Kent Kangley Road exit near Kent.

The collision shattered the windshield of Kearney’s Mustang, ripped out the driver-side door and left Kearney with severe head injuries.

Investigators said the truck driver then fled, leaving Kearney for dead.

Alongside the victim’s car, troopers found two auto parts they believe belong to the truck driver’s car — a left taillight assembly and a post possibly belonging to a flat-bed truck.”

Investigators are continuing to search for leads regarding the identity of the other driver. If and/or when he or she is identified and apprehended, serious criminal charges are likely to be filed, and the defendant would face prosecution for crimes that would carry a term in prison if convicted.

Aside from the serious criminal nature of the situation involved, the driver would also face substantial civil liability if he or she is ever caught.
