Serious Injuries In Hit-and-Run Accident

hit-and-run, Washington auto accident lawyers

February 18th, 2010: Law Blogger

1800 block of 356th in Fed Way - Phillips WebsterFederal Way – Two pedestrians were run over on the 1800 block of Southwest 356th Street in Federal Way shortly before 7pm last night.

The most seriously injured victim, a young man in his late teens, was airlifted by helicopter to Seattle’s Harborview Medical Center with life-threatening injuries, Federal Way Police spokesman Raymond Bunk said. The other victim, a 50-year-old man, was transported by ambulance to Harborview with non-life-threatening injuries.

A young man suspected to be the driver was taken into custody. He had suffered minor injuries, Bunk said. He was believed to be in his late teens or early 20s. His identity was not disclosed.

Investigating officers were initially unsure if alcohol or drugs were factors in the accident, which generally means that alcohol and/or drugs were involved.

Our thoughts are with the victims in this hit-and-run accident. It is always fortunate when a person survives getting hit with a one ton vehicle going at a high speed. It makes for a long hard recovery involving physical therapy and time away from work, which can result in loss of income.

If you or a loved one are injured in a pedestrian or hit-and-run accident it is best to acquire legal council immediately. Call Phillips Webster for a consultation on your legal options.

35th ave ne & 110th ave neNorth Seattle – A man was driving his 1998 Ford Explorer on 11000 block of 35th Avenue Northeast just before 7am on Friday when he swerved suddenly, sideswiped a parked van and then slammed into a parked SUV. Neither vehicle was occupied at the time.

It is speculated that he was going at a high speed or sped up at the time of the incident because he hit the SUV so hard that the vehicle was pushed onto the sidewalk, careened off of a tree, and came to a rest propped against a light pole.

The man was unconscious at the scene of the accident and appeared seriously injured. Fire Department Medics took him to Harborview Medical Center in Seattle.

At first, Investigators suspected that alcohol may have contributed to the cause, but upon further investigation have determined that neither drugs nor alcohol were factors in the incident. Instead they are waiting for a medical explanation. The investigation continues.

Impaired Driving in Washington State

DUI, fatalities, impaired driving, injuries, Washington auto accident lawyers, Washington state

October 16th, 2009: Washington Law Blogger

Everyone understands the dangers involved and the potential for tragedy that’s tied to the issue of impaired driving, and Washington is no different than the rest of the country in this regard. The bottom line is that when someone makes the decision to get behind the wheel after having too much to drink or ingesting other substances, it’s far more likely that someone will get hurt or even killed. If this has happened to you or someone you love, a Washington auto accident lawyer should be one of the first people you contact.

In terms of statistics, Washington appears to be making positive gains when one looks at the number of DUI charges filed in the state, but those raw numbers are still quite troubling. The state recently released its DUI statistics for the calendar year of 2008, and more than 40,000 people were charged with some sort of impaired driving during the year. That represents a slight decrease from 2007, but that’s still enough people to fill a small city.

Of those 40,000 people, 17,000 people were convicted and approximately 18,000 agreed to a plea bargain of lesser charges. It should be noted, however, that not every charge levied was resolved in the same year in which it was issued. Regardless, what this should tell anyone is that despite all the efforts to curb this behavior, impaired driving remains a serious problem in Washington and poses an extreme risk for everyone on the road.

When this happens, many people aside from the police should be involved, particularly if someone is injured or killed as a result of these bad choices. Criminal liability can be severe in the worst DUI cases, but that should not mean that those who are guilty of this conduct escape civil liability from those who have been injured in an accident that was even partially due to impaired driving.

If you or someone you love has been injured or worse because of an impaired driver in Washington, you need to take immediate action. Your first step should be to contact the Washington auto accidents lawyers at Phillips Webster today to schedule a free initial consultation.

Rear End Collisions in Washington

air bags, neck injuries, rear end collisions, seat belts, soft tissue injuries, Washington auto accident lawyers

October 15th, 2009: Washington Law Blogger

One of the most common types of collisions that occurs between vehicles is the rear end collision. These types of accidents are particularly dangerous because many times, the driver who is hit does not have nearly enough time to react to the oncoming vehicle and even in instances where he or she does see it coming, it’s impossible to take evasive measures for any number of reasons. Therefore, Washington auto accident attorneys regularly speak to those who have been injured in such crashes, and below is a brief overview of the issue.

Common Injuries

When a rear end collision occurs, it leaves the passengers in the car that’s hit in an extremely vulnerable position, even if they are wearing seat belts and have air bags in the proper places. The reason is that the human body is simply not engineered to endure violent collisions from the rear, and when the body is forced forward at high speeds several injuries can result. Specifically, these injuries often involve the neck and spine, and even soft tissue injuries can result. What’s worse is that these soft tissue injuries can be difficult to diagnose and can take some time to even reveal themselves by way of overt physical symptoms.

Fault Questions

Fortunately in Washington and just about everywhere else, there is a bit of a presumption of fault when a rear end collision occurs. Numerous studies have shown that rear end collisions are often the result of a distracted driver, which means that the driver who rear ends another car is found to be at fault the vast majority of the time. The presumption is rooted in the fact that an attentive and properly defensive driver should have been traveling at a safe speed and provided him or herself with enough time and space to avoid such an incident.

How to Proceed

If you have been involved in a rear end crash, you need to seek immediate medical help, even if you do not feel that you are injured. When that is complete, you need to contact the Washington auto accident lawyers at Phillips & Webster today to schedule a free initial consultation.

Side Impact Accidents in Washington

fatalities, injuries, side impact accidents in Washington, side impact collisions, T-bone crashes, Washington auto accident lawyers

October 12th, 2009: Washington Law Blogger

Auto accidents occur in the thousands in Washington every year, and these accidents can happen in innumerable ways. This includes the manner in which collisions can occur, and one of the most dangerous types of crashes is the side impact collision. There are many reasons for this heightened danger, but the fact is that Washington auto accident lawyers are constantly fighting for the rights of those harmed in these types of collisions for a reason.

On a national level, it’s estimated that approximately 21% of all fatal auto accidents in the United States are side impact accidents, and as many as 25% of non-fatal auto accidents occur in the same manner. Side impact collisions are also known as ‘T-bone’ collisions, whereby one vehicle slams into the side of the body of the other, either on the driver’s or the passenger’s side.

One of the reasons that the side impact collision is so dangerous is because there are still millions of vehicles on the road in the United States and hundreds of thousands in Washington that do not have side impact air bags and others that have no air bags at all. When a collision occurs from the side, the driver or the passenger absorbs the full force of the other vehicle with only a few inches of metal separating a person’s body from the front fender of the other car.

People are also seriously injured in side impact accidents because of the way in which their body is tossed as these crashes occur. Aside from exposing a person’s rib cage and vital internal organs to the crash, when a body is thrown from side to side, it opens up the possibility of numerous injuries on almost any part of the body, and anyone could be thrown from the vehicle that’s hit if he or she is not wearing a seat belt.

Regardless of the specifics of any side impact crash, the fallout from them is almost always severe for those who feel the impact. If this includes you or someone you love, you need to contact a Washington auto accident lawyer as soon as possible to schedule a free consultation.

AAA’s Heads Up Driving Week a Call to Everyone

AAA, American Automobile Association, distracted drivers, heads up driving week, Washington auto accident lawyers

October 9th, 2009: Washington Law Blogger

Auto accidents occur both in Washington and across the United States at an alarming rate. There are more than 6 million such incidents every year nationally, and thousands of them occur right here in Washington. While many have heard about some of the common causes – speeding, drinking and driving and the like – distracted drivers are responsible for more than one million crashes every year, according to the American Automobile Association (AAA). As such, Washington auto accident lawyers are seemingly constantly speaking to new clients about what went wrong.

The AAA has reacted to this growing problem by coming up with a concept known as Heads Up Driving Week, which runs from October 5th through October 11th. The AAA has asked that during this week, drivers from everywhere in the United States take some basic steps in an attempt to break the bad habits that tend to lead to distraction and thereby raise the chances that an accident will occur. Some of these steps include:

  • Staying off the cell phone
  • Refraining from texting
  • Eating before or after the trip
  • Making sure children and pets are secure before departing
  • Stashing loose items properly
  • Focusing in on the driving task at hand
  • Taking some time to self-evaluate your driving habits

Of course, these are just a few examples, but the week is designed to not only help drivers realize what they need to do in order to improve their own driving habits, but also to find out if the accident statistics tend to go down if enough people actually take the necessary steps to drive properly. Regardless, practicing better driving habits and just basically paying more attention to the road cannot be a negative.

Unfortunately, not everyone will know about this week and therefore will not make those same adjustments, but you can control what happens inside your vehicle and you should. If nothing else, it will provide you with some insight into just how dangerous it is to be inattentive while behind the wheel, and it could help you avoid an accident. If you or someone you love has been injured in such an incident, however, you need to contact the Washington auto accident lawyers at Phillips & Webster as soon as possible to schedule a free initial consultation.
