Graco has recently warned consumers of finger laceration and finger amputations from three models on their stroller line; The Graco Passage Stroller, The Graco Alano Stoller and the Graco Spree Stroller. These reports of serious injuries all involve the hinge mechanism that’s attached to the canopy component of the models that have been recalled. This hinge that allows for the canopy to be adjusted is exposed, and several children have touched this hinge while the canopy was being adjusted by the parents.
Specifically, seven reports have been recorded. Two children suffered deep and severe lacerations on their fingers as a result of direct contact with the hinge while it was in motion. Even more seriously, five children have had fingers severed from their hands while the same sort of contact was made. It was these reports that led to the steps that have been taken by Graco in conjunction with the United States Consumer Product Safety Commission (CPSC).
While the official term to describe the situation involving these defective Graco baby strollers is a recall because both the company and the CPSC have advised consumers to stop using the models in question, the immediate response regarding a solution could create additional problems.
This immediate response involves those owners affected by this situation to contact Graco in order to obtain a free repair kit. This repair kit is basically a cover for the hinges that to this point have been exposed so that no additional direct contact with this dangerous moving part is possible.
This is problematic for more than one reason. First, these parents will not be able to safely use these products until these repair kits arrive and are installed. Secondly, this solution leaves it up to the parents to install this cover, and many if not most parents do not have experience working in a Graco baby stroller manufacturing plant. Finally, if a parent installs the cover and his or her child is still injured by this part, it could allow Graco to present a defense that states that the cover was improperly installed, and that this improper installation is what led to the injuries. This could prevent Graco from being exposed to liability.
